Information: All personal data held by EnVoix for customer relationship management, analysis, and statistical purposes.
User: refers to an internet user who accesses the aforementioned website.
Personal information: “Information that allows, in any form, directly or indirectly, the identification of the natural persons to whom it applies” (Article 4 of Law No. 78-17 of January 6, 1978).
The terms “personal data,” “data subject,” “processor,” and “sensitive data” have the meanings defined by the General Data Protection Regulation (GDPR: No. 2016-679).
Introduction
The purpose of these general terms of use and GDPR (hereinafter referred to as “TOU & GDPR” is to provide a legal framework for the terms and conditions governing the provision of the website and services by the EnVoix Association and to define the conditions of access and use of the services by the “User.”
These TOU are available on the website under the heading “TOU-GDPR” at the bottom of each page of this website.

The website festivalbarenvoix.com provides users with free access to the following services:
- Information about the Bar’EnVoix organization and program.
- Purchase tickets for the Bar’EnVoix festival.
- The option to join the EnVoix association.
- Access to information and partnership documents.
- Users can also fill out and share a message in the guestbook.
- Contact the EnVoix Association or any other committee.
The website is free and accessible to any user with an internet connection. Users are responsible for all costs incurred to access the service, including hardware, software, and internet connection.
The site uses JavaScript technology. The website cannot be held responsible for any material damage related to the use of the site. Additionally, users agree to access the website with recent, virus-free equipment and an up-to-date, latest-generation browser. The festivalbarenvoix.com website is hosted by a service provider within the European Union, specifically on a server located in Paris – France, in accordance with the General Data Protection Regulation (GDPR, No. 2016/679).
Use of the website implies full and complete acceptance of the general terms and conditions of use described below. These terms and conditions may be modified or supplemented at any time.

The website ensures that users‘ personal information is collected and processed in accordance with privacy laws, in compliance with:
- Law No. 78-17 of January 6, 1978, as amended by Law No. 2004-801 of August 6, 2004, and Law No. 2018-493 of June 20, 2018, relating to information technology, files, and civil liberties.
- Law No. 2004-575 of June 21, 2004 on confidence in the digital economy.
Under the Data Protection Act of January 6, 1978, users have the right to access, rectify, delete, and object to the use of their personal data. Users may exercise this right:

EnVoix may process all or part of the data:

Once your testimonial has been validated, your profile photo will be publicly visible alongside your testimonial.
- When contacting the association: Last name, first name, email address
- EnVoix also collects information that helps improve the user experience and provide contextualized advice: data required for Google Analytics. This data is kept for a maximum period of 13 months after the end of the contractual relationship.
EnVoix does not sell your personal data and information, which is therefore only used when necessary or for statistical and analytical purposes.
Within the limits of their respective responsibilities and for the purposes outlined above, the main people likely to have access to user data are primarily members of the EnVoix association’s board.
ARTICLE 4: Intellectual property
The website https://festivalbarenvoix.com constitutes an intellectual work protected by the provisions of the Intellectual Property Code and applicable international regulations. Users may not, under any circumstances, reuse, transfer, or exploit for their own purposes any part or all of the elements or works on the website.

If we become aware of a security breach, we will notify the users concerned so that they can take appropriate measures. Our incident notification procedures take into account our legal obligations, whether at the national or European level. We are committed to fully informing our users of all issues relating to the security of their accounts and to providing them with all the information necessary to help them comply with their own regulatory reporting obligations.

In their publications, members agree to comply with the rules of Netiquette (rules of good conduct on the Internet) and the rules of law in force.
The site may moderate publications and reserves the right to refuse to publish them online, without having to justify its decision to the member.
Members retain all of their intellectual property rights. However, by publishing content on the site, they grant the publisher the non-exclusive and royalty-free right to represent, reproduce, adapt, modify, disseminate, and distribute their publication, directly or through an authorized third party, worldwide, on any medium (digital or physical), for the duration of the intellectual property rights. In particular, the Member transfers the right to use their publication on the Internet and on mobile phone networks.
The publishing company undertakes to display the member’s name alongside each use of their publication.
Any content posted online by the user is their sole responsibility. The user undertakes not to post any content that may harm the interests of third parties. Any legal action taken by an aggrieved third party against the site will be borne by the user.
The user’s content may be deleted or modified by the site at any time and for any reason, without prior notice.

French law applies to this contract. In the event of failure to reach an amicable resolution of a dispute between the parties, the French courts shall have sole jurisdiction.
